The City of Banning has implemented several important regulations and processes for the operation of cannabis-related businesses. Below is an overview of key details for those interested in cannabis cultivation, manufacturing, testing, and retail operations.
As of May 14, 2019, the appeal process for retail cannabis regulatory permits has concluded. A lottery took place on May 23, 2019, to determine which applicants would receive one of the three available permits. This lottery was open to the public, and applicants were encouraged to attend.
Only three cannabis retail permits are available in the city. Once a retailer secures a regulatory permit through the lottery, they must apply for a conditional use permit (CUP) to operate legally.
The City Council has removed the 600-foot separation requirement for industrial cannabis facilities. This change, effective as of May 21, 2019, allows cultivation, manufacturing, and testing laboratories to be located closer to residential zones. However, all other state-mandated setbacks must still be adhered to. Industrial cannabis businesses can now apply for regulatory permits directly through the Community Development Department.
